Mediation

Mediation for Separating Couples in Scotland

Request a Consultation

What is mediation?

Mediation is a voluntary process which helps separating couples discuss the practical issues that need to be resolved. An independent mediator supports both people to talk constructively, identify the issues, and explore possible solutions. The mediator does not take sides or make decisions for you.

What can mediation help with?

Mediation can help with many of the important decisions that arise after separation, including arrangements for children, the family home, money, property, and future communication. It gives you a structured space to focus on practical outcomes rather than past conflict.

The aim of mediation

The aim is to help you reach your own agreement where possible. That can be especially important where children are involved, because it encourages better communication and helps parents make arrangements that work for their family in the longer term.

Why consider mediation?

Mediation can be quicker, less stressful, and more cost-effective than court. It is private, flexible, and allows you to stay more in control of the outcome. Instead of a Sheriff deciding what should happen, you and your former partner have the opportunity to shape arrangements that suit your circumstances.

Do I still need a solicitor?

Yes. A mediator can help you communicate and explore options, but you should take legal advice before and during mediation. A solicitor can explain your rights, help you understand whether any proposal is fair, and prepare a separation agreement if agreement is reached.

Is mediation right for everyone?

Mediation is not suitable in every case. It may not be appropriate where there has been domestic abuse, intimidation, or a serious imbalance between the parties. A mediator and solicitor can help you consider whether mediation is safe and suitable for your situation.

Taking the first step

If you are separating and unsure what to do next, early legal advice can help you understand your options. We can advise you on whether mediation may be suitable, how to prepare for it, and how any agreement can be properly recorded and made legally binding in Scotland.
